The FBI and Department of Homeland Security are investigating Thursday’s ICE-involved shooting in Marble Hill that left 28-year-old Oscar Belgal wounded and a 5-year-old boy caught in the chaos.
The announcement comes as advocates rallied outside of New York Presbyterian Allen Hospital, where the man was recovering. Chanting “ICE out of the Bronx,” protesters pushed up against barricades, demanding answers for the violence that unfolded between Marble Hill Avenue and 225th Street.
The Department of Homeland Security says they were conducting a targeted ICE enforcement operation at around 4p.m. to apprehend what the agency described as a “criminal illegal alien from the Dominican Republic” who allegedly has multiple prior arrests and gang ties.

In a press conference on Friday, United States Secretary of Homeland Security, Markwayne Mullin, justified the forcible measures against Belgal. He said Belgal had a criminal past that includes robbery, grand larceny, and forcible theft, including gang ties.
"He also was known to be affiliated with the gang that was, associated with shooting a CBP officer last year. We have believe that Oscar has either indirect or direct knowledge of the shooting, and that's why he became a target," said Mullin.
Exclusive video from the scene captures a heartbreaking moment after the shooting. A young child can be seen reaching toward Belgal handcuffed lying on the pavement. In Spanish, the boy is heard repeatedly crying out, “My dad.”
Investigators are now reviewing the circumstances surrounding the shooting. The NYPD commissioner and officials say evidence collected at the scene indicates that an ICE agent fired at least seven rounds during the encounter, striking the driver in the neck.
The incident has drawn sharp criticism from city leaders. Mayor Zohran Mamdani called the shooting “an outrage,” using the episode to renew calls for ICE to leave New York City.
“We know that ICE is rotten to its core,” Mamdani said. “Today’s shooting is only further devastating confirmation of what we have long known, which is that ICE operates with impunity, that they sow chaos and terror across our country.”
The mayor added that efforts to negotiate the driver’s release with President Donald Trump’s administration had been unsuccessful as of Thursday night.
Meanwhile, officials say the 5-year-old boy who was present during the incident is now with family members.
Police tells News 12 five people were taken into custody from the protests sparked by the shooting, for offenses including disorderly conduct, resisting arrest, harassment, obstruction of governmental administration.
